DAILY WATERCRAFT RENTAL AGREEMENT & LIABILITY WAIVER
1. RENTAL PERIOD, SECURITY DEPOSIT & RATES
• Maximum Rental Duration: Standard Daily Rental is strictly limited to 8 HOURS MAX. All watercraft must be returned to designated dock location no later than 8 hours from departure time.
• Security Deposit: A mandatory $250.00 refundable security deposit is required prior to departure. Deposit is fully refunded upon return inspection if vessel is clean, undamaged, and full on fuel.
• Late Return Penalty: $100.00 per hour (or fraction thereof) for late returns past the 8-hour limit.
2. MANDATORY SAFETY RULES & REGULATIONS
• Life Jackets (PFDs): USCG-approved PFDs must be worn by all children under 13 years at all times while underway. Approved PFDs are provided for all passengers.
• Strict Sobriety (Zero Tolerance): Operating under the influence (BUI) of alcohol or drugs is strictly prohibited by RI Law and voids all insurance/agreements.
• Navigation Rules: Must observe all no-wake zones, speed limits, channel markers, and USCG rules of the road. No beaching or anchoring in prohibited surf zones.
• Capacity Limit: Do not exceed posted maximum weight or passenger limits.
3. DAMAGE RESPONSIBILITY & UNBREAKABLE HOLD HARMLESS WAIVER
Renter assumes full financial responsibility for all loss, damage, prop strike, hull impact, equipment damage, or salvage costs incurred during the rental period. Renter agrees to inspect vessel prior to departure.
INDEPENDENT WAIVER & INDEMNIFICATION: Renter agrees to hold harmless, defend, and indemnify Ocean State I & E Rentals LLC, its owners, and agents against any and all claims, liabilities, bodily injury, or loss arising from the rental or use of the watercraft.
